Kerala Consumer Wins Rs 2 Lakh in Tour Company Dispute

In Short: A Kerala consumer has won Rs 2.05 lakh from a holiday company after the firm failed to arrange a complimentary foreign trip as promised.
A Kerala consumer forum has ordered a holiday company to pay Rs 2.05 lakh to a bank employee after he purchased a holiday membership but allegedly did not receive the promised complimentary foreign trip to Malaysia or Maldives.
The man, Abhilash Sankar S, paid Rs 1.45 lakh in December 2023 after being assured of a complimentary three-night, four-day trip, including round-trip airfare from Kerala.
The commission noted that the company failed to arrange the foreign tour despite repeated communications and even offered an alternative Dubai trip with additional charges, which the man refused.

- President S K Sreela, along with member Stanly Harold of the Kollam District Consumer Disputes Redressal Commission, heard the complaint filed by Abhilash Sankar S, who purchased a holiday package from the tour company in 2023 with an offer of a complimentary trip that was never provided to him.
- Noting that the company remained absent despite service of notice, the commission found that it had not placed any evidence on record to explain why the promised tour was not arranged or to show that the man had received the services for which he had paid.

- The man moved the commission, alleging that the company’s failure to provide the promised tour, its subsequent demand for additional payment and failure to refund the amount amounted to deficiency in service and unfair trade practice, causing him financial loss, mental agony and hardship.
