The Calcutta High Court directed state authorities to provide a provisional domicile certificate to Sourav Sarkar, an Army aspirant, who was shortlisted but required a domicile certificate for the next phase of the recruitment process.
Justice Krishna Rao ordered the Sub-Divisional Officer of Basirhat to grant the temporary certificate to Sarkar, provided he satisfies all other eligibility conditions except for his voter registration status. The court noted that without the certificate, Sarkar would not be allowed to participate in the physical examination test by the defence authorities.
Sarkar’s legal representatives, Asif Dewan and Mehedi Masud, argued that local authorities had refused to issue the domicile document solely because his name no longer appeared on the electoral roll. The court asked the appellate tribunal to handle Sarkar’s appeal as quickly as possible, ideally within a week of receiving the order.
The court made the relief conditional, requiring Sarkar to return the provisional certificate within one week if he loses his appeal regarding his voter list deletion. This decision ensures that the recruitment process can proceed without being derailed by the voter-list dispute.
